The e-commerce of NAPP Sagl exclusively concerns the sale of food products imported from all over Italy, ceramics and various products from the Amalfi Coast.

Access to and consultation of this website implies acceptance by the user of the General Conditions set out below. NAPP Sagl reserves the right to modify these General Conditions at any time.

Art. 1 General information

The information contained on the website is for information only and is updated periodically.

The general conditions are applied to the E-commerce sale of “handcrafted products imported from Positano, Ischia and the Amalfi Coast” on the NAPP Sagl website www.lemeraviglibypositano.ch with legal and operational headquarters in Switzerland, Via Borgo 11, CH-6612 Ascona. Registered in the Commercial Register of the Canton of Ticino Order number CH-501.4.019.023-7, Business identification number (IDI) CHE-143.152.819, VAT number CHE-143.152.819 VAT.

The general conditions are applicable exclusively to sales contracts with buyers, in accordance with the provisions of the Swiss Federal Law against unfair competition (LCSI), Article 3, paragraph 1, in force since April 2012:

“In particular, anyone who offers goods, works or services through electronic commerce acts unfairly, failing to clearly and completely indicate his identity and his contact address, including his e-mail address”

Art. 2 Definitions

Seller: NAPP Sagl with registered and operational headquarters in Switzerland, Via Borgo 11, CH-6612 Ascona, registered in the Commercial Register of the Canton of Ticino with order number CH-501.4.019.023-7, Business identification number (IDI) CHE-143.152.819, VAT number CHE-143.152.819 VAT.
Buyer: Natural person who buys the products, aged no less than 18 years.

Sale: Online (remote) sale of products through the website.

Art. 3 Prices

The price in Swiss Francs is shown for each product on the website. The seller reserves the right to change the price of the products at any time.

The buyer is charged the published price in effect at the time of the order and mentioned on the order confirmation. All prices are inclusive of taxes. For related information contact info@lemeravigliebypositano.ch. The prices shown for each product do not include shipping costs and Value Added Tax (VAT), which are indicated separately.

Art. 4 Acceptance of orders

The order sent by the buyer is binding on the seller only if the order process has been completed correctly and completely.

Art. 5 Order confirmation

The sale is concluded when the buyer receives the order confirmation.

Art. 6 Conditions and methods of payment

Advance bank transfer in Swiss Francs for customers who expressly request it via the contact form on the website www.lemeraviglibypositano.ch or via the email address info@lemeravigliebyposiatano.ch; must be carried out at the expense of the sender’s bank and the beneficiary at the full expense of the purchaser, in favor of the account:

Name of the beneficiary: NAPP Sagl – Ascona TI.

Name of the institution: Swiss Post, Postfinance – CH – 3030 Bern.

CCP: 69-768382-8.

IBAN: CH47 0900 0000 6976 8382 8.

The order will be effective only after the amount has been credited to the bank account of NAPP Sagl.

Credit cards: Visa, MasterCard, Postcard. The service is managed by Postfinance Switzerland which guarantees the buyer the security of the data entered. NAPP Sagl is not aware of such data but will only receive confirmation of payment. PostFinance Switzerland uses the automatic encryption system (https 🙂 for data protection.

Art. 7 Invoicing

The invoice is sent on request by the buyer by e-mail or in paper form upon receipt of payment.

Art. 8 Place of supply

For customers in Switzerland and Liechtenstein, the place of supply is the warehouse at NAPP Sagl, Via Borgo 11, 6612 Ascona (CH).

Art. 9 Shipping

9.1 Times for taking charge of the order

Bank transfer and credit cards: The seller takes delivery of the order within 1 working day from when the account of NAPP Sagl has been credited.

9.2 Communication of incorrect data

The seller is not responsible for sending the goods to incorrect addresses provided by the buyer and no refunds of any kind will be made. Returning the goods will be treated as a new order.

9.3 Delivery times

The package is delivered within 1-2 working days from the receipt of the order.

NAPP Sagl is not responsible for any delay in product delivery times or for reasons of force majeure not dependent on the will of NAPP Sagl itself.

9.4 Shipping costs

The shipping costs in Switzerland and Liechtenstein are calculated on the basis of the weight and volume of the shipment requested by the buyer and are indicated before the order confirmation.

Art. 10 Non-delivery

If the buyer or the person appointed by him is not present at the time of delivery of the package, the goods will be in storage at the nearest post office and reported in the notice of non-delivery.

Art. 11 Delivery of incorrect product

If the delivered product is not the one ordered, the buyer must notify the seller within 48 hours of delivery. For communication, the buyer will use our email info@lemeravigliebypositano.ch or our telephone number 0041 (0) 798991748. The buyer must return the wrong product to the NAPP Sagl warehouse, Via Borgo 11, 6612 Ascona (CH). The shipping costs will be paid by the seller.
Once the return has been received, the seller will ship the replacement product at his own expense. This clause lapses if the wrong product is not returned to the seller in intact conditions and including the original packaging, within the times indicated above.

Art. 12 Right of withdrawal

12.1 Waiver of Purchase

The buyer has the right to communicate to the seller at the email address info@lemeravigliebypositano.ch  the renunciation of the purchase making use of the right of withdrawal, within 7 days from the date of receipt of the product which must be returned to the seller intact and in the original packaging. The shipping costs for returning the product are the sole responsibility of the buyer. The seller is not liable in any way for damage, theft or loss of the returned products, in such cases the right of withdrawal lapses. The seller will refund the cost of the returned product, net of delivery costs, within 15 days from the date of receipt of the returned product. The refund will be made by bank transfer. The return shipment will be addressed to NAPP Sagl, Via Borgo 11, 6612 Ascona (CH).

12.2 Delay in delivery

If the delivery of the goods is not made within 15 days from the date on which the buyer has sent the order confirmation, he has the right to withdraw from the contract by communicating his renunciation to the email address info@lemeravigliebypositano.ch and the amount, if already paid, will be refunded by direct remittance within 10 days of cancellation by bank transfer.

12.3 Product not available

If the ordered product is not available, the buyer can cancel the order without penalty.

Art. 13 Liability

The seller has no responsibility for the improper and incorrect use of the products made by the consumer.
Any liability of the seller in relation to the state of the products, due to improper storage after the time of delivery, is excluded. It is recommended to read the instructions for use on the package labels.

Art. 14 Privacy

For privacy, the provisions of the Swiss Federal Law (PLD) of 19 June 1992 on data protection apply. Federal law requires that:

* the buyer’s personal data is used only for the purpose indicated on the website and at the time it was obtained;
* the information may in no way be disclosed to third parties or outside the Swiss borders, except for the serious exceptions provided for by law;
* personal data must be protected with appropriate technical (encryption) and organizational measures against any type of unauthorized use.

The acquisition of the buyer’s personal data, i.e. name, surname, address, email, telephone, fax, is only necessary for the acceptance of the order by the seller and for the shipment.
The sole recipient of the buyer’s personal data is the seller, who may not in any way transmit them to third parties, unless this is necessary to carry out the order. Credit card payment data is transmitted encrypted and processed directly by PostFinance which uses the most advanced techniques (SSL = Secure Socket Layer) to ensure the utmost confidentiality of such data. The buyer’s email address may be used by the seller to send newsletters or promotions relating to the products, only after approval by the buyer. Personal data are processed in paper format and / or with automated tools for the time necessary to achieve the purposes for which they were collected. NAPP Sagl is not responsible for any unauthorized access or loss of personal information outside of its control.

Cookies

Information regarding your identification can be stored on your computer: these data are called cookies. These files are stored on your hard drive, allow us to recognize you as a registered customer and facilitate the use of our website. The use of session cookies (which disappear when the browser is closed) is limited to the transmission of session identifiers, necessary to allow safe navigation and efficiency of the site. Art. 15 Applicable Laws and Jurisdiction

In the event of a legal dispute, the competent court will be exclusively that of the Swiss Court of the Canton of Ticino (Mendrisio). Swiss law is exclusively applicable.
